Acceptable Use Policy (AUP)
AUP - Table of Contents
1. Introduction
This Acceptable Use Policy (“AUP”) forms part of the governing Master Services Agreement between Webklipper Technologies Private Limited, including its subsidiaries (Hereinafter referred to as “WebEngage”) and its Customers and Users, and sets forth the permitted and prohibited uses of the Services. This policy safeguards the integrity, security, and lawfulness of the Services and associated systems. Use of the Services signifies acceptance of this AUP.
2. Scope of the AUP
This AUP applies universally to Customers, Authorised Users, end-users, and any third-party agents accessing or using the Services.
3. General Use
- Use the Services lawfully, with appropriate authorisation and in accordance with contractual obligations.
- Protect access credentials, implement access controls, including MFA where possible, and report unauthorised use immediately.
- Ensure use aligns with WebEngage policies and applicable regulatory requirements for Customers and Users.
4. Prohibited Activities and Content
You may NOT:
- Conduct, support, or facilitate any illegal, harmful, fraudulent, or abusive activity.
- Distribute malware, ransomware, or malicious code.
- Violate intellectual property, privacy, or confidentiality rights.
- Generate or disseminate false or misleading information, including AI-generated disinformation.
- Engage in spamming, phishing, unsolicited messaging, or deceptive marketing.
- Attempt unauthorised access, tamper with security controls, overload or disrupt the Services.
- Use Services to harass, stalk, or cause harm to others.
- Impersonate any individual or entity or misrepresent affiliations.
5. Customer Responsibilities
- Manage user roles and permissions securely by implementing MFA and conducting regular credential reviews.
- Ensure all processed data complies with applicable laws and has the necessary consents.
- Obtain all required licenses for content uploaded or generated through Services.
- Maintain audit logs where applicable and cooperate with audits.
6. Third-Party and Sub-processor Compliance
- Customer must ensure that third-party vendors and sub-processors used in conjunction with this AUP comply with this AUP and applicable laws.
- WebEngage may subcontract Service components, ensuring that sub-processors adhere to similar standards and notify Customers of material changes.
7. SLA Integration and Enforcement
- Service-level commitments, such as uptime, response times, and support procedures, are defined in the Master Subscription Agreement and its associated SLAs.
- Prohibited-use incidents that affect SLA performance may trigger enforcement actions, including suspension or termination, in accordance with this AUP and the SLA terms.
- Customers must report violations promptly; WebEngage will investigate and escalate remediation in accordance with SLA guidelines.
8. AI-Specific Prohibited Uses and Governance
- Prohibited AI uses include manipulative, discriminatory, or deceptive applications; unauthorised use of biometrics; and unfair social scoring.
- AI-generated content must be disclosed transparently.
- Customers must monitor AI outputs for bias, conduct impact assessments, and maintain human oversight for high-risk use cases.
- AI model tampering or the creation of unauthorised derivative works is prohibited.
9. Data Retention, Privacy, and Law Enforcement Requests
- Customer Data is retained in accordance with our Data Retention Policy and securely deleted when no longer necessary, except under lawful hold.
- Compliance with Applicable Laws and Rules mandates breach notifications within 72 hours of becoming aware of a personal data breach, where required by applicable law.
- Lawful government requests for data are strictly verified and communicated to Customers unless prohibited.
- Data disclosures are limited to the minimum information required.
10. Security Incident Response
- Both WebEngage and Customers must follow the incident response plans defined in SLAs and applicable regulations.
- Incidents must be reported promptly, with timely updates and remediation actions documented.
11. Auditing and Monitoring
- WebEngage reserves the right to monitor Services usage and audit Customer compliance with this AUP.
- Customers shall maintain relevant records and provide reasonable assistance during audits.
12. Reporting Violations and Appeals
- Violations can be reported to
or via established channels. - WebEngage will investigate and provide the Customer with opportunities to respond before disciplinary action is taken, except where immediate suspension is warranted.
- Appeals may be submitted in accordance with the dispute resolution provisions of the governing agreement.
13. User Education and Updates
WebEngage commits to providing periodic training, policy updates, and resources to promote the ethical and compliant use of AI and its services.
14. Modification of Policy
This AUP may be amended with prior notice via email or Dashboard. Continued Service use after notice constitutes acceptance.
15. Governing Law and Dispute Resolution
This policy is governed by the laws specified in the Master Subscription Agreement. Disputes will be resolved in accordance with the agreed arbitration or jurisdiction clauses.
